Retired Army Colonel Nelson Irizarry claims the university unlawfully cut his salary by $25,000 because of his race, national origin and religion after he moved from a tenure-track professor to an instructor. The university denies the allegations, saying the pay reduction was tied to his change in position after he did not complete a required tenure review.
U.S. District Judge Robert Schroeder denied the university's request to dismiss the lawsuit but said the claims came close to being dismissed. A jury trial is scheduled to begin September 28 in federal court.
